I think they'd have a tough time based on an indictment alone, and there's still controversy over whether the relevant section of the amendment even applies to a president.

Unless it can be proven he was born outside of US territory, hasn’t lived in the US for at least 14 years, or is secretly lying about being older than 35, there is no law that can explicitly disqualify him from becoming President.

He deserves accountability for his actions, no matter his future plans.
