Agreed. Even if you are in the right it'll take you way more than $50 to take them to court to fight this.

You signed the lease. You're right, it's binding. Have you tried just asking your LL if you pay on the fifth, 'just to prevent hardship' or to break your payment into two payments, 1st and 15th. Get it in wrighting (confirmation text) if he agrees.

Generally leases are written as due on the first with a five day grace period. But to answer your question you go by whatever your lease states that you most recently signed.

I'm wondering if OP had an unofficial grace period- ie due by the first but "just get it to me by the 5th and it'll be ok" but the new mgmt company is going strictly by the lease?

The due date is likely the 1st. You usually have until the 6th before you incur a late fee. So, if the payment clears on the 5th, you are, technically, late, but within the allowable time.

I assume you had a one or two year lease agreement, and not a 4 year lease agreement. So your lease either went month to month at some point or you had to sign a new lease.

If you are month to month, then they can raise the rent anytime with 1mo notice. So regardless of whether it’s due on the 1st or 5th they can choose to raise your rent with one month notice. I’m not sure if them saying you have to “pay on the first or else” would count as notice or not, but it might. Even if it doesn’t though they can increase it the next month.

If you have a lease but don’t have or lost your copy you could ask the property management company for a copy. Not sure if they are obligated to give it to you, but unless they are really shady I would think they would.

At the end of the day if it’s not a big deal to pay earlier then you should probably just do it, rather than cause yourself more problems.

Submit it by the first. You probably ignored agreeing to yet another binding contract that changed the date on you at some point in the past.
