I think having a clean record, showing up and being respectful will go a long ways in having that not happen.
Worse comes to worse I think it’s only a 30 day suspension.

100% chance?? Are you the lawyer?

Everyone’s a lawyer on the internet.

There is not. A friend of mine was clocked doing 70 in a 35, coming out of those tolls at the start of 295. Didn’t realize the speed limit dropped so much there coming off 95. They went to court, no lawyer, pled down and paid a $500 fine. Never lost their license.

At least he was really sorry.

His insurance is probably about to turn into another car payment, but I’m not sure how helpful a lawyer will be - he may want to save the money.
35 generally means houses. Pushing 70 in a residential area is something that deserves punishment. No way you’re going to be able to stop if a dog (or kid) runs out into the road.
Does he have a dash cam, or any way he can contest the speed? A lawyer is only going to be useful if there’s something to argue.

68 in a 35? Wow

Class E offense. The maximum is:
- Six months in jail and/or
- A $1000 fine and/or
- A year of probation and/or
- A minimum 30-day administrative license suspension.
The suspension is almost completely assured. The Secretary of State's office will send an envelope to his mailing address, and he'll have to send his license to them. As an administrative suspension, there is nothing he can do to prevent this. If this is the case, it would be a good idea to get a non-driver ID card in the interim. It's hard to get anything done when you don't have a valid ID.
Also, in order to prove criminal speeding, the arresting officer needs to have recorded:
- The stated speed limit of the road.
- The actual speed that the driver was operating at.
- And they need to establish that the speed was more than 30 mph above the legal speed limit.
Based on your information, he was traveling at 33 mph above the speed limit. Radar guns are generally accurate within 2 mph, but radar guns need to be calibrated regularly (every 6-12 months), or they become inaccurate.
As others have said, he needs to talk to a lawyer. This can probably get pled down to just a fine and the administrative suspension, but he won't know until he's spoken to a lawyer.

Where do you get the information that you have to send you lisence in to the state? I'm not saying you're wrong, but when I lost my lisence for speeding many a moon ago, I didn't have to do anything like that
ZingZongZaddy t1_j09g3ck wrote
You can fight an administrative suspension. You file an appeal with the BMV and an appointment is made for you and the officer to sit down with a representative. You have to argue your case well, but if the officer doesn't show up it's likely to be dismissed.
Ambitious_Ask_1569 t1_j08ggas wrote
Double the speed limit is reckless operation at its best. Get a lawyer. Its a shit ton of points. Just short of a DUI.
His insurance will probably double if not triple.
Tony-Flags t1_j08ist6 wrote
Show up on time (early) to court. Dress nice- doesn't need to be suit and tie, but show respect for the court. If he can afford it, bring a lawyer. Don't make excuses about being late to something or in a hurry, that doesn't go over well.
Be prepared to be humble and penitent. He can't expect to talk his way out of any punishment, but by being contrite and remorseful, he may be able to mitigate punishment.

+2 on getting the lawyer. Might be able to work out a plea deal to a lesser speed over if he does online remedial driver's ed and some other stuff. But it'll be expensive.

With that difference, how did he not know he was going that fast?
At least he's learned his lesson though, so props to him.

sometimes the do-gooders that come out on these posts are hysterical. there a FUCK TON of roads in this state that are marked 35 or 45 that many many people do north of 60 on, especially late at night. this person doesn’t need a lecture about how bad of a person their brother is. do you all remember what it’s like to be young or are the grandmas and grandpas on this sub so far removed from reality that they’ve forgotten about the times maybe they themselves have gasp GONE OVER THE SPEED LIMIT 😱

Whelp, he deserves losing his lisence. There's no back roads in maine that have a speed limit of 65.
I lost my lisence when I was 17 for doing 60 in a 45. Bumming rides for 30 days taught me something.
Pay the price and call it a lesson learned.
Honestly, do you really think a lawyer will get him out of trouble for getting caught doing almost twice the speed limit?
RelationshipBig2798 t1_j08vqkl wrote
It's a toss up. A lawyer may get it down to nothing or do nothing and be a waste of time and money.
Majestic-Feedback541 t1_j09hpwg wrote
You don't know every road in Maine, my dude. There are quite a few back roads with speed limits between 45-70. Usually (from my experience) there's miles and miles before a turn off or civilization.
Though I do agree with just paying the price and learn from this experience

Name a non-divided, non-state/interstate highway in maine with a speed limit above 55mph. I’ll wait.
It doesn’t exist. People may do 65-70 on US201 in the West forks, but the speed limit is still only 55.
Majestic-Feedback541 t1_j09jmbk wrote
OMG, thank you for giving me so much credit! This has never happened to me before.
I know very few street names. I'm not a name person, I'm a "that road up there on the right" kind of person. I could literally drive you there, but can't for the life of me give directions, much less name the roads.
(It's ok, I know 100% how pathetic that is)

There’s a minuscule chance he won’t if he gets a lawyer, but if he goes in without a lawyer there’s 100% chance he will.
