Not all speech is protected. If she had written ot all down and posted it online, she wouldn't have been arrested.

There is no "Hate Speech" statute in PA. It's an enhancement charge of Ethnic Intimidation. In this case, it's secondary to the charge of Harassment--which is an overreach on the prosecutor's part. All things considered she'll probably plea out and the overreach won't matter.

Speech is also verbal. ‘Hate speech’ is protected speech regardless of its form.

Threatening someone is not protected speech. She threatened to run him out of town.
