Yes, how? I'm trying to get a "holding fee" back for an apartment I ended up not wanting (it's illegal to charge holding fees in NY).

Ny- application fees are legal. Application deposits are not.

Application fees are paid at the time of application submission and are generally nonrefundable.

An application deposit is also known as a holding deposit. An application deposit is a deposit paid to the landlord by the applicant at time of application to request the landlord hold the rental unit for the applicant until the processing of his application has been completed.

There's a complaint form for illegally withheld security deposits on the website of the AG office. They will investigate and try to mediate. The form is here: https://ag.ny.gov/complaint-forms#housing under "Rent security deposit and apartment application fees."

This is it. I sent this form and they must've gotten in touch with my LL. At which point he must've started taking my threats to sue a little more seriously and returned my money.
