The witness is at worst a coward, but nowhere near a murderer.

I can’t blame them for not wanting to intervene though, I’d like to think I would, but who can say unless you’re in the situation.

Except that isn't how the Good Samaritan law works. The law protects people who a good faith effort to save someone from a drug overdose or other life threatening injuries from criminal or civil liability. Good Samaritan laws are not failure to report laws which apply only to professionals with a legal obligation to report suspected crimes.
