Unpaid Time Off in MA

Hey y’all,

Not quite sure if this is the best place to pose this question, but figured I’d give it a try.

My employer doesn’t allow time off requests unless we are using PTO or Sick Time. Can they legally refuse to honor unpaid time off?

Yes, unless it's covered by something else like Covid time, FMLA, or other regulations.

You can take the time anyway, and they can fire you.

They do not have to Honor unpaid time off.

All your sick time and vacation time has to be used, then FMLA will protect your job for 12 weeks unpaid.

After that you can be out unpaid but your job is not protected.

Yes. If you have no injury, or some other event that is covered, if you don't want to go to work your employer is not obligated to employ you. You can call it a firing but it will be seen as quitting.

No technically they dont have to honor it. But if it was me id hit them with the “ well im still not gonna be here that day. Sorry but i need the day and thats the end of that” and if they fire you over that they are either a real shitty employer or you are very replaceable.
