File the report, and see a lawyer. I know you don't want to but this seems like an easy case of mental distress and trauma. That's how things are changed the MTA hates paying out settlements and this seems like an easy win. Get your money, you're entitled to it

The MTA would definitely remove the driver from service if this report is credible. They've done more for less
