As I learned from bitter experiences, most if not all credit card merchant agreements say the seller is responsible until it is in the customer’s hands. Giving it to a carrier does not end the responsibility of the seller. At least that is the case with Visa, Mastercard, American Express and Discover in the US.

If you paid by credit card the seller is responsible for the product until you take possession. It is in the seller’s credit card agreement. This should be an easily disputed charge.

It is not about the states laws. It is in the merchant agreements with the credit cards. At least that is the way it was when I ran an e-commerce business.
