I got on a 6 train last week, last car. Some asshole was sitting up one end smoking, the car reeked. So I "simply moved to the next car", as you so helpfully suggest. Whereupon I discovered another asshole, in that car, also smoking. And then again! Three fucking cars in a row, all with a dude smoking and stinking up the place. It's absolutely ridiculous.

They are allowed

Per the MTA: "Dogs and other animals must be in a bag or other container and carried in a way that doesn’t annoy other riders. Service animals and working animals with law enforcement agencies are allowed at all times."

The New York State Clean Indoor Air Act actually does prohibit smoking and vaping on "public means of mass transportation, including subways, underground subway stations, and, when occupied by passengers, buses, vans, taxicabs and limousines" and "ticketing, boarding and waiting areas in public transportation terminals".

So, yeah, someone smoking in the station probably is a crime. Clearly not on the same level as violent crime, but still illegal.
