Not nearly strong enough of a charge. That's a summary offense. They'll get $300 fines for throwing animal urine on a person and vandalism. Littering has a higher penalty.

If there were a similar percent (3000) of 18-25 year olds in Pittsburgh doing this you'd never hear the end of it on this sub or the news

Harassment in PA law is a form of assault. To charge Simple Assault there needs to be bodily injury or attempt to cause bodily injury. Assuming this is deer urine that was purchased and not drawn from a rotting corpse, I don’t think there’s a risk of bodily injury.

Assault is essentially the “act” of harming someone without physical contact. Battery is physical contact causing harm.

In this situation, if the people had a bottle of “deer urine” and pretended like they were throwing it, that’s assault. Physically throwing it and making contact is battery.

Depending on which statutes are in play assault often covers things that don't necessarily require physical contact with the victim, and has a lesser penalty. Battery is when you do actually make physical contact with the victim and carries stiffer penalties.

Offensive physical contact is assault.

Simple assault, 18 Pa.C.S. 2701, includes "attempts to cause or intentionally, knowingly or recklessly causes bodily injury to another." "Aggravated assault" in Pennsylvania, 18 Pa.C.S. 2702, basically involves serious bodily harm or an attempt to do so.

There is no separate crime of battery in Pennsylvania. "Battery" is subsumed in the assault statutes. Other states may have different laws on assault and some do have a distinct crime of "battery."

"Battery" traditionally means an offensive physical contact, and is basically a civil tort concept. If I punch you in the face in Pennsylvania, I will face a criminal assault charge, and you can file a civil lawsuit for money damages, based on battery.

As far as I know, this Walmart sells deer piss in a spray can. It’s supposed to help attract deer or something when hunting. Idk why. But they sell it and most likely where they got it from

Something about Walmart that brings out the worst in people. Recently there were two incidents of two men spilling various liquids on the floors at a Walmart near Hamburg. Hope they catch them (see WFMZ website for details), since it seems only a matter of time they do the same thing, but escalate it somehow.

As with many states, such crime is often treated as little more than a ticket. However, the victim could file lawsuits against Walmart and the four men. Walmart will likely fight back hard while the four men are likely uncollectible with little to no assets to go after (aka judgement proof). Still worth a try though. If anything, may encourage that particular Walmart to improve security.

To digress, it's disconcerting how few security personnel many big box stores have on duty at any given time compared to stores of yesteryear. Some stores (not saying Walmart per se; maybe they're better?) have long periods during the day when zero AP / security employees are scheduled. Compounding matters is they're often instructed to not engage even to protect customers. Totally hands-off is the norm these days due to liability concerns.

Safety is another reason many shop on-line and/or use curbside pickup, which some retailers push hard. Still though, deer urine isn't the first threat I'd think of. Could have been far worse.
