I love the Roth because it allows for withdrawals (no emergency = no withdrawal )

Mom's insurance company has a team of lawyer's, and they said they are not covering the damages.

I hate to break it to ya, but since the driver did not steal the car (owner gave him permission to drive), the driver will have to pay and the other insurance company may also sue the car owner (they are going to want to be reimbursed).

The 401k will be paid to the stated beneficiary that you list on that account.

There may be laws in your state that prevent you from naming anyone/anything other than your spouse as beneficiary of your 401k without your spouse's consent? Contact your 401k provider and request a beneficiary change form (the form may require spouse's signature)
